The duration of the management assignment will be that established therein. In the absence of an express agreement, the duration of the management assignment will be one (1) year. Upon expiration of the order, unless reliable notice of any of the parties with thirty (30) days in advance, it will be extendable for successive and equal periods.
The AGENCY will carry out diligently, and with the necessary help of the OWNER, a report of the property that will include an extensive collection of photographs, a detail of the elements that constitute the property, a global description of it and a price and conditions of payment and guarantee. This report, owned by the AGENCY, will be published both on the agency's websites and on the most important generalist Real Estate portals (such as Idealista, Fotocasa, etc.), as well as on the most widespread social networks. The report will be offered well in advance to the OWNER for review and, where appropriate, adjustment. Additionally, the property will be offered directly both to the portfolio of CLIENTS of the AGENCY and to all CLIENTS and interested parties from all the geographical areas covered by the AGENCY, and may be part of its advertising campaigns, both on the Internet and through traditional media (press, mailbox, mailing, etc.). In any case, the AGENCY will periodically inform the OWNER about the access and interest expressed by probable buyers or tenants, thus facilitating possible adjustments of the conditions of sale or lease of the properties transferred for management to the AGENCY.
The OWNER authorizes the AGENCY, during the term of the order, to take photos of the properties object of the same, and to publish them together with descriptive reports of the property and its characteristics both on its own websites (mariatomasa.com and red.mariatomasa.com) and on generalist real estate Web portals (Fotocasa, Idealista, etc.), as well as in generic or specific advertising or real estate development campaigns. To facilitate the work of dissemination and promotion of the properties object of the management order, the OWNER undertakes to provide the AGENCY with access to them to make and mount their report, in addition to providing the AGENCY with their keys or, failing that, be available and present when arranging visits with potential CLIENTS; In addition, the OWNER will promptly communicate to the AGENCY the variations that may occur in the price or conditions of payment or guarantee of the property.
The OWNER expressly undertakes and hereinafter to carry out any real estate operation that includes clients, interested parties or contacts provided by MARIATOMASA S.L. with the necessary mediation of MARIATOMASA S.L., whose participation and fees it recognizes with respect to the operations that may occur with such clients with respect to the property whose management is entrusted to it.
The AGENCY is not authorized to receive amounts in concept of deposits or signals that imply the establishment of contractual conditions with respect to the OWNER or the farms whose management is entrusted to the AGENCY. The only valid documents that will bind the OWNER will be those expressly signed by the owner.
The fees of the AGENCY for its management and real estate mediation services with respect to the property object of the order, are those established and signed by OWNER and AGENCY in the management order, taxes excluded, and payable by who is expressly indicated in the same order document. In any case, the fees of the AGENCY will accrue in full if, being in force or having expired this order or despite having been terminated for any reason, the lease or sale occurs to any of the CLIENTS presented, in person or electronically, by the AGENCY to the OWNER, or to any third party or interposed person directly related to those clients, previously known or not by the OWNER.
The AGENCY offers the OWNER, as an inseparable part of its mediation work and included in its fees, legal-tax advisory services that include the drafting, at the will of the OWNER, of the relevant lease and / or sale contracts, as well as personalized support regarding any doubts or issues that may arise both the mediation itself and the real estate operation final, including related to insurance, expertise or auxiliary services (reforms, cleaning, etc.).
